The Catch
Five cases of the same structure. Heller gave it the name, but the trial penalty may be the sharpest instance — a constitutional right that punishes its own exercise without anyone having to abolish it. The system doesn't need to remove the exit. It just needs to make the exit expensive enough that using it becomes evidence against you.
The Dunning-Kruger case is the most recursive: the tool you need to diagnose the problem IS the problem. Jury nullification is the most architectural: the power is real but cannot be transmitted through the channels the system provides for transmitting power.
